Inexperienced Surgeon Sued In Medical Malpractice Lawsuit

A man who had surgery at Atlanta Spine recently filed a medical malpractice lawsuit against his doctor and the clinic. According to the lawsuit, in February 2018, the man underwent a surgical procedure that injured his spinal cord, leaving him with permanent brain injuries. Now he wants to make sure the doctor doesn’t make the same mistake on any other patients.

The Details Behind the Medical Malpractice Case

The lawsuit states that when the patient was trying to decide whether to agree to a somewhat risky surgery to fix a calcified disc in the thoracic spine, his doctor reassured him that it would be safe and that he’d performed the same surgery over 20 times in the past. This led the patient to proceed with the surgery, which turned out to be a mistake because the doctor took the riskiest approach possible and left the man with serious injuries.

The man’s calcified disc was located in his upper back, just below his neck. It’s rare for surgeons to even perform disc surgery in this area, and when they do, they usually approach from either the front or sides. But this doctor opted to come at the disc from the back, requiring the surgical instruments to pass by the spine, risking injury. And that’s exactly what happened to the patient, who now has to live with permanent injuries to the spinal cord due to surgical error.

Additionally, the lawsuit alleges that the doctor did not put a drain at the surgical site, causing a hematoma to form and compress the spinal cord—likely making the patient’s spine injury worse. And after the doctor noticed the hematoma, he waited more than five hours to treat it. Clearly, this doctor was not as familiar with the surgery as he claimed, which is why the patient is bringing the lawsuit against him.

In fact, the complaint states that if the doctor had been honest about his lack of experience with this surgery, the patient would have sought a more experienced surgeon for the procedure instead. For this reason, the lawsuit states that the doctor violated the standard of care, acting negligently in numerous ways and causing serious harm. The patient is seeking the following damages in his medical malpractice lawsuit:
